The thing that trips people up in Madison County is that the rules change depending on which side of the city line you're standing on. Inside the City of Jackson, the city's zoning ordinance governs your fence and the city requires a fence permit. Outside the city, in what the county calls the Outer Region, the county's zoning resolution applies instead, and the permitting question is answered differently. Same county, two sets of paperwork. The ground matters before you set a post. Madison County sits in the Gulf Coastal Plain over the Mississippi Embayment, with uplands mantled in wind-blown loess silt, the opposite of Middle Tennessee's limestone karst. You won't fight rock here. You'll fight silt that drains fast when loose and turns to soup when saturated, so the hole is easy and the hold comes down to diameter, concrete, compaction, and drainage. Outside Jackson and Three Way, Madison County is farm and timber ground and the conversation changes. On a subdivision lot the question is how it looks. On acreage it is what the fence has to hold, how far it runs, and what has to drive through it.

Madison County Fence Permits and Zoning

Here is what is actually on the books, and nothing beyond it.

Unincorporated Madison County. A building permit is not required for a standard residential fence 7 feet or under, under the code the county has adopted. Anything taller than that triggers a permit and structural review. The county's zoning resolution for the Outer Region also has a sight-triangle rule at street intersections: on a corner lot, inside the area formed by the center lines of the intersecting streets and a line joining points 100 feet from the intersection, nothing may obstruct vision between 2½ feet and 10 feet above the average street grade. If you're on a corner, that rule decides what you can build near the intersection, so bring it up at the estimate.

What we will not tell you. Neither the county's published zoning resolution nor the city's ordinance sets a maximum height for a side or rear yard residential fence, so we're not going to quote you a number for that. If a contractor tells you "six feet is the max in the back yard in Madison County," ask him where it's written. For anything not covered above, call the Madison County Building Department and ask about your specific address and zoning district before you set posts.
